Brownfields are defined by the Florida Department of Environmental Protection (FDEP) as abandoned, idled, or underused industrial and commercial facilities where expansion or redevelopment is complicated by real or perceived environmental contamination. The primary goals of Florida's Brownfields Redevelopment Act (Ch. 97-277, Laws of Florida, codified at ss. 376.77-.85, F.S.) are to reduce health and environmental hazards on existing commercial and industrial sites that are abandoned or underused due to these hazards and create financial and regulatory incentives to encourage voluntary cleanup and redevelopment of sites. After a local municipality in Florida designates an area as a brownfield to encourage redevelopment and focus upon revitalization, a resolution is passed and property owners within that designated area optionally may remediate or redevelop their property. Executed Brownfield Site Rehabilitation Agreements (BSRAs) are voluntary cleanup agreements between a responsible party and FDEP or a delegated local pollution control program. This agreement provides the FDEP and the public assurance that site rehabilitation will be conducted in accordance with the statute and the Brownfields Cleanup Criteria rule (Ch. 62-785), and provides liability protection for the responsible person. The agreement contains various commitments by the responsible person, including milestones for completion of site rehabilitation tasks and submittal of technical reports and plans as agreed to by the responsible person and the DEP. It also contains a commitment by the FDEP to review technical reports according to an agreed upon schedule. This layer provides a polygon representation of the boundaries of sites within a designated Brownfield Area within Florida where BSRAs have been executed between FDEP and a responsible party.

Additionally, this update includes the resubmission of 2 sites where the BSRA had been superceeded by a more recent agreement or the responsible party voluntarily withdrew from the agreement. Previously, the spatial data for Wynwood Site (BF139801001) within the Miami Area had been removed because the responsible party voluntarily withdrew from the agreement, which disqualifies the responsible party for incentives under Brownfields Redevelopment. However, the historical documents regarding this agreement are still available. The BSRA for the DR Lakes, Inc. Parcel II (BF500101004) site within the Former Palm Beach Lakes Golf Course was superceeded by the BSRAs for sites BF500101005 and BF500101006 where the cleanup responsibilities were divided into two separate parties. In order to view the more recent spatial boundaries and documents related to the history of this site, see also the BSRAs for DR Palm Beach Hotel Complex Brownfield Site (BF500101005) and DR Palm Beach Residential Complex Brownfield Site (BF500101006). Including the spatial data for these two sites despite the fact that their agreements are no longer valid allows the historical documentation for these sites to remain available to the public. Also, all public access reports showing a list of Sites with Executed BSRAs that previously listed these BSRAs will now be consistent with the spatial data layers, allowing the public to use either the public reports or spatial data as a source for the same information.

In order to streamline productivity and updates to the Brownfields spatial data layer, several changes were proposed, and a new spatial data layer was created to incorporate those changes. These changes included (1) removing the point representation so that only the polygon layer is maintained by program staff; (2) adding new columns that would show the date the BSRA was executed along with the date the SRCO was issued for sites where cleanup is complete; (3) adding the X Coordinate and Y Coordinate columns to the polygon layer to allow points to be rendered from a single source; (4) renaming columns to include a logical break in the column names using an underscore character; and finally (5) renaming columns to match the naming conventions used in the cross referenced spatial data layers. Each of these changes were incorporated into the new layer. The old point and polygon layers used to represent Sites with Executed BSRAs will be deprecated on January 15, 2008 and will no longer be available through FDEP for download or future updates. These deprecated layers are called Brownfield Sites with Executed BSRAs (areas) and Brownfield Sites with Executed BSRAs (points).
